Torna alla homeTerms of ServiceGeneral Terms of Use of the MoviQ platform. Version 1.0 — in force from 1 May 2026. The official, legally binding version is the Italian one.

1. Definitions

• "Platform" — the website moviq.it, its possible mobile versions and every digital service provided under the MoviQ brand.
• "MoviQ" or "we" — the legal entity that owns the Platform, MoviQ S.r.l. (being incorporated), with registered office in Italy.
• "User" — any adult natural person who accesses the Platform to search, compare and book a vehicle rental.
• "Rental company" — an economic operator, a natural person holding a VAT number or a legal entity, duly authorised in Italy to carry out self-drive vehicle rental, that publishes its offer on the Platform.
• "Service" — the activity of publishing rental listings and connecting User and Rental company provided by MoviQ through the Platform.
• "Rental contract" — the autonomous contract concluded directly between User and Rental company at the time of vehicle pickup, governed by the conditions of the individual Rental company and applicable Italian law.

2. Subject and nature of the ServiceMoviQ is an INFORMATIONAL INTERMEDIATION platform that allows Users to search, compare and send booking requests for vehicles to independent professional Rental companies operating in Italy.MoviQ's activity qualifies as an information society service under Italian Legislative Decree 70/2003 and Directive 2000/31/EC, and as a provider of online intermediation services under Regulation (EU) 2019/1150.MoviQ is NOT a party to the Rental contract. MoviQ does NOT own vehicles, does NOT provide the rental service, does NOT collect, hold or process payment for the rental on behalf of the Rental company, does NOT manage deposits, securities, excesses, insurance policies or accidents. The Rental contract is concluded and performed entirely between User and Rental company, is governed by the contractual conditions set by the individual Rental company and by applicable law, and produces no legal effect on MoviQ.Everything relating to the rental relationship — including but not limited to: cancellation policy, amount and method of the deposit, insurance coverage, handling of damage, fines, accidents, payment disputes, loss or theft of the vehicle, assistance during the rental — is governed solely by the Rental company's contract and falls under the exclusive responsibility of User and Rental company.3. Registration and accountUsing the booking features requires creating a personal account. Registration requires a valid email, first name, last name and phone number, and acceptance of these Terms and the Privacy Policy.The User warrants that the data provided is truthful, complete and up to date, and undertakes to keep it so for the entire duration of registration. It is forbidden to create accounts using others' identities, false data or fictitious names with deceptive intent. Access is via magic link sent to the registered email address (passwordless authentication).The User is responsible for safeguarding their credentials (in particular access to the email inbox associated with the account) and for any activity carried out through their account. In case of unauthorised or suspected use, the User must report it promptly to support@moviq.it.4. Booking processThe User chooses a vehicle, indicates pickup and return dates and times, and sends a booking request. The request does NOT constitute conclusion of the Rental contract, nor does it cause any charge or hold on the User's payment methods.The Rental company has 24 hours to accept or decline the request. If accepted, the User receives confirmation by email and push notification. The Rental contract is finalised at the time of vehicle pickup, at the agreed time and place, by signing the Rental company's paper or digital contract and paying the price.The price shown on the Platform includes the base rental price, mandatory liability insurance, applicable taxes and, where indicated, the included mileage. Any extras (additional driver, child seat, GPS, accessory coverage, fuel) are indicated separately. The final price may change as a result of changes to the rental period requested at pickup or damage assessed at return.5. Cancellation and changes5.1 — Cancellation, change, no-show and penalty policies are set by the individual Rental company and indicated on the vehicle listing at the time of booking. MoviQ does not determine, collect or manage any cancellation penalty.5.2 — By way of illustration only, most Rental companies provide free cancellation up to 24 hours before pickup; beyond that threshold, retentions may apply. The exact value is always indicated by the Rental company.5.3 — Changes to the booking (dates, duration, vehicle) require the Rental company's consent and are subject to availability. MoviQ does not guarantee the acceptance of changes.6. User obligations and responsibilities

• Provide truthful data at registration and booking.
• Show up at vehicle pickup with a valid ID document and a driving licence suitable for the booked vehicle's category.
• Comply with the contractual conditions set by the Rental company (mileage, permitted area, use restrictions, return procedures).
• Use the vehicle in accordance with the Highway Code and applicable law.
• Be personally liable for administrative penalties, fines, damage caused to third parties or to the vehicle during the rental period, within the limits set by the contract and the insurance coverage.
• Not use the Platform for unlawful, fraudulent purposes or those harmful to third-party rights.

7. EXCLUSIVE obligations and responsibilities of the Rental companyThe Rental company is the SOLE and EXCLUSIVE party responsible, towards the User, the Authorities and any third party, for everything relating to the vehicle and the Rental contract, including by way of example and not limited to:

• availability and suitability of the vehicle at the agreed time, place and conditions;
• maintenance, inspection, type-approval and compliance of the vehicle with road safety rules;
• taking out and maintaining adequate mandatory liability insurance on the vehicle;
• management of excesses, collision waivers, excess reductions and any other accessory coverage offered or sold to the customer;
• collection of the rental fee and management of the deposit/security;
• issuing receipts, invoices and tax documents to the customer;
• handling of accidents, damage, repairs, disputes, fines, administrative seizures and any other event connected to the use of the vehicle;
• compliance with tax, anti-money-laundering, privacy and consumer regulations in relations with the customer;
• correctness, truthfulness, completeness and updating of prices, photos, descriptions, conditions and payment methods published on the MoviQ listing.

The Rental company indemnifies and holds MoviQ harmless from any claim, damage, cost, penalty or legal expense (including fees of lawyers and experts) arising from its rental activity or from the breach of applicable rules.8. Exclusion and limitation of MoviQ's liability8.1 — MoviQ is subject only to the responsibilities of an information society service provider under Articles 14, 15 and 17 of Italian Legislative Decree 70/2003. In no case does MoviQ assume obligations of the Rental company or enter into any contractual relationship with the User concerning the vehicle rental.8.2 — Within the limits permitted by applicable law, MoviQ is NOT liable, by way of example and not limited to, for: (a) unavailability, delay, defects or breakdowns of the vehicle; (b) road accidents, damage to property or persons, loss or theft of the vehicle; (c) disputes arising between User and Rental company relating to payment, deposit, excess, insurance, rental conditions or return; (d) unlawful, fraudulent or negligent conduct by the User or Rental company; (e) breaches, errors, omissions or false statements by the Rental company in the content published on the Platform; (f) Service interruptions due to maintenance, updates or force majeure; (g) indirect or consequential damage, loss of opportunity, profit or reputation.8.3 — MoviQ does not offer, in any form, assistance during the rental, dispute mediation or arbitration. Reports received via support@moviq.it are used solely for platform moderation and service quality: they do not constitute any assumption of liability by MoviQ nor a right of the User to a specific outcome or response time.8.4 — Should a competent authority establish — in derogation from the above — direct liability of MoviQ, this is in any case limited to the amount possibly received by MoviQ for the single contested transaction, and in any case may not exceed €100 per single event or €500 in total per calendar year. The mandatory consumer rights provided by applicable law are unaffected.9. ReviewsA User who has completed a rental may leave a review of the Rental company. Reviews must be truthful, based on personal experience, and free of defamatory, offensive, discriminatory or unlawful content. MoviQ reserves the right to remove reviews that breach these rules or that are manifestly false or manipulative.10. Account suspension and closureMoviQ may suspend or close an account, with written notice by email stating the reasons, in case of: breach of these Terms; fraudulent, harmful or dangerous conduct towards other Users or Rental companies; repeated failure to comply with Rental companies' conditions (e.g. repeated no-shows); prolonged inactivity (over 36 months from last access). The User may close their account at any time from the "Settings → Account" section or by writing to support@moviq.it.11. Intellectual propertyThe "MoviQ" trademark, the logo, the interface, the source code, the editorial texts, the graphics and any other original content of the Platform are the exclusive property of MoviQ S.r.l. and protected by copyright and industrial property law. Photos and descriptions of vehicles remain the property of the respective Rental companies, which grant MoviQ a limited, non-exclusive, revocable licence for publication on the Platform.12. Changes to the TermsMoviQ may change these Terms at any time to adapt them to service developments or regulatory changes. Substantial changes are communicated to registered Users with at least 30 days' notice by email. The version in force is always available at moviq.it/termini. Continued use of the Platform after the changes take effect implies their acceptance; otherwise the User may withdraw by closing the account.13. Applicable law and jurisdictionThese Terms are governed by Italian law. For disputes arising between MoviQ and Users qualifying as consumers under Italian Legislative Decree 206/2005, the court of the consumer's place of residence or domicile has exclusive jurisdiction. For disputes with non-consumer Users and with Rental companies, the court of Milan has exclusive jurisdiction.The consumer User may also turn to the European ODR platform for the alternative resolution of online disputes: ec.europa.eu/consumers/odr.14. Final provisionsIf any provision of these Terms is declared null, invalid or unenforceable, the remaining provisions remain fully effective. MoviQ's tolerance of User breaches does not constitute a waiver of the rights provided by the Terms or by applicable law.
